Americans with Disabilities Act (ADA) Information
ADA Policy Statement
The Americans with Disabilities Act (Title II) states, in part, that “no otherwise qualified disabled individual shall, solely by reason of such disability, be excluded from the participation in, be denied the benefits of, or be subjected to discrimination in programs, services or activities sponsored by a public entity.” At the Town of Limon, we are committed to complying with the requirements of Title II of the ADA in all of its programs, services, benefits and activities.
The Town of Limon provides safe and efficient transportation within the community we serve. The Town of Limon Outback Express provides door–to-door service for the frail, elderly, and persons with disabilities. Door-to-door means that drivers assist passengers from their homes and assist them back to the door in a safe and polite manner. All able-bodied passengers are given curb-to-curb service meaning they are picked up in front of their homes and delivered in front of their destinations unless door-to-door service is requested.
Training
The Town of Limon provides training for the safe operation of the vehicles, adaptive equipment, sensitivity and proper treatment of the frail, elderly, persons with disabilities, and the ADA regulations.Public Information and MarketingCommunicate to the community by providing route information, brochures, and in presentations that explain how our services meet ADA requirements. Policy and related forms are posted and available at Town Hall as well as the townoflimon.com website. ADA information will be made available at all public hearings and listening sessions.

Title VI Information
The Town of Limon is committed to ensuring that no individual is excluded from participation in, denied the benefits of its programs, activities or services, or subject to discrimination on the basis of race, color or national origin as per the Title VI of the Civil Rights Act of 1964, as amended.
Toward this end, The Town of Limon’s departments and employees are responsible for carrying out the commitment to non-discrimination including the requirements of Title VI. This includes the following:
- To ensure that the level and quality of transportation services are provided to all;
- To promote full and fair participation in transportation decision making;
- To ensure meaningful access to Limon’s programs and activities by persons with limited English proficiency;
- To identify and address, as appropriate, the human health, social, economic and environmental effects of its programs and activities on all populations.
Complaint Procedures
Federal law prohibits discrimination on the basis of race, color, national origin, age, sex, or disability in any Town of Limon Outback Express program or activity.
Federal law requires that the Town of Limon investigate, track, and report discrimination complaints. Complaints must be filed in writing and will be investigated within sixty days of submission. Who is eligible to file a complaint?
Anyone who believes they have been excluded from participation in, denied the benefits of, or otherwise subjected to discrimination under any Town of Limon program or activity because of their race, color, national origin, age, sex, or disability may file a complaint.
Discrimination includes lack of access, harassment, retaliation and disparate impacts from a program or activity. Harassment includes a wide range of abusive and humiliating verbal or physical behaviors. Retaliation includes intimidating, threatening, coercing, or engaging in other discriminatory conduct against anyone because they filed a complaint or otherwise participated a discrimination investigation.
How do you file a complaint?
Complaints must be filed in writing within 180 days from the last date of the alleged discrimination. However, contact the Colorado Department of Transportation Civil Rights and Business Resource Center (CDOT CRBRC) if you believe your complaint may fall outside this deadline.

The Town of Limon will make reasonable efforts to assist persons with disabilities, non-English speakers, and others unable to file a written complaint. For assistance in filing a complaint, please contact the Town of Limon at (719) 775-2346.

What happens after a complaint is filed with The Town of Limon?
Most complaints will be investigated within sixty days. Investigating a complaint includes interviewing all parties involved and key witnesses. The investigator may also request relevant information such as books, records, electronic information, and other sources of information from all involved parties.
In some cases, the Town of Limon Outback Express must forward complaints to either CDOT, the Federal Highway Administration or Federal Transit Administration for investigation. If your complaint is forwarded to one of these agencies, you will be provided the name and contact information of the employee handling your complaint.
Federal law prohibits retaliation against individuals because they have filed a discrimination complaint or otherwise participated in a discrimination investigation. Any alleged retaliation should be reported in writing to the investigator.
